ASA TERMS & CONDITIONS

By booking your surf tour, surf lesson, surf van or surf and yoga retreat with Australian Surfing Adventures, you agree to all of our terms and conditions and Driveabout Campers terms and conditions when hiring one of the surf adventure vans, and in this document will be referred to as the customer. Australian Surfing Adventures will be sometimes referred to as ASA. ASA reserves the right to evict anyone at any time that does not comply with these terms and conditions with no refund.

You as the customer acknowledge that there are risks with surfing, surf camps, entering the ocean and traveling including driving in a different country. All of these factors can present particular dangers to you and your wellbeing. This could result in injury to you or other customers.

By the full extent permitted by Australian law, Australian Surfing Adventures is excluded from any liability to the customer and will not be responsible for any loss, damage or injury to the customer arising from or connected with any activity or van hire conducted by Australian Surfing Adventures no matter how that injury, damage or loss is caused.

Every customer is responsible for their own property that they bring on our tours. Australian Surfing Adventures will endeavour to provide locked storage for valuable items and documents such as passports. ASA does not accept any liability for loss, theft or damage of these items whilst in storage or at any time during our tours.

THE TOURS

All customers participating in ASA’s surf camps, surf lessons, surf coaching, ASA activities, ASA surf van hire at their own risk.

The customer must abide by all instructions given by ASA staff at all times. The customer agrees not to disrupt or interfere with other customers and only operate in a safe and secure manner at all times.

The customer acknowledges that ASA reserves the right to cancel, change or relocate one of our tours operated by us at any stage.  If it is deemed by an ASA employee to be too dangerous to continue a tour or activity they will be relocated or cancelled for the day. The customer acknowledges that weather conditions cannot be controlled by ASA and agrees that ASA is not liable for any loss, damage or inconvenience to the customer or customers’ property if such a situation arises.

The customer acknowledges that cancellation of a tour or activity can happen at any time and agrees that there will be no refund. The customer also agrees that ASA has the exclusive right to exclude any customer from the camp or tour at any time at ASA’s own discretion.  The customer also agrees that ASA will make a decision on whether a partial refund is applicable to the customer at this time.

EQUIPMENT

The customer agrees to pay in full for any damage caused to ASA equipment or accommodation due to a negligent act deemed by ASA staff. ASA will endeavour to provide all equipment for use in an adequate condition but is not responsible or liable for a customer’s injury whilst using such equipment.

THE BEACH

The customer agrees not to deface or relocate anything from any beach. The customer agrees to no littering at any times and will leave the beach in exactly the way they found it. The customer agrees that this will result in exclusion from the camp or tour immediately with no refund.

THE SURF CAMP AND ACCOMMODATION

The customer agrees not to deface or remove any object or equipment from any surf camp or its accommodation. The customer agrees that this will result in exclusion from the camp or tour immediately with no refund. ASA reserves the right to inspect any bag being brought on any tour at any time.

DRUGS & ALCOHOL

No customer is allowed to bring drugs or alcohol to any surf camp or tour.  Failure to abide by this will result in immediate eviction from the tour or camp and also result in further action by the Australian Police.

The customer agrees to inform ASA of any medications required to bring on tour before arrival.

The customer agrees that all surf lessons, activities and tours require a 0.00 blood alcohol reading. Failure you to comply with this will result in missing your lesson with no refund.

MEDICAL CONDITIONS

The customer agrees to provide information on any medical conditions prior to commencing any of  ASA’s tours, activities, lessons or hiring one of ASA’s surf vans.  Before commencement of any tour, activity, lesson, or van hire the customer declares they are free from any medical condition that may hinder their safety.  ASA is not responsible or liable for injury, damage or fatality that is caused by a medical condition.

CANCELLATION & REFUNDS

ASA reserves the right to cancel any trip in which case a full refund will be paid to the customer.

All deposits are non-refundable.

Cancellations received 90 days prior to the tour will receive a full refund minus the deposit amount.

Cancellations received 60 days prior will receive a 75% refund minus the deposit.

Cancellations received 30 days or less to the scheduled booking are non-refundable.

If booking your own travel insurance please ensure that you’re covered for any unforeseen circumstance such as illness or accidents.

PRICES

ASA reserve the right to vary prices and rates in the event of changes in exchange rates or price rises made by suppliers.  ASA is not liable in any way if a price increase occurs. All prices are quoted in Australian dollars and are subject to fluctuation in exchange rates until fully paid. No booking will be processed unless a full deposit has been received by ASA.

PAYMENT

The customer agrees to make all payments on time to avoid cancellation of their booked tour and loss of deposit.

RESERVATION CHANGES

All reservation changes are subject to availability and may incur a booking fee.

DOCUMENTATION

Our general practice is to send documents to our customers electronically whenever possible.  ASA reserves the right to charge an administration fee should you make a request for a hard copy of these documents to be sent.

REPORTING INCIDENTS & COMPLAINTS

If you have a complaint during your holiday, tour, surf camp, lesson or activities please see your ASA staff member immediately to get this problem resurrected.  If they are unable to resolve the matter they will contact management who will then resolve the matter. Any abnormal incidents including injuries, service problems, cancellation of services or dissatisfaction must be reported to ASA during the event to allow us the opportunity to rectify the situation or provide assistance.

CREDIT CARD SURCHARGES

Credit card surcharges apply when paying with a credit card.

Visa/Mastercard = 1.5%

Diners = 2.89%

American Express = 3%

If you pay for your tour with a credit card the customer agrees not to charge back your payment to ASA.

TRAVEL INSURANCE

ASA strongly recommend travel insurance prior to starting any of our camps, lessons or tours to protect you from any unforeseen circumstances throughout your journey. ASA can organise your travel insurance and recommends an unlimited medical cover, including medical evacuation, to be purchased at the time of your deposit being paid, to cover cancellation fees. YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS

By booking your surf camp, surf tour, surf yoga retreat, surf lesson, activity, accommodation or surf van or using our website, the customer is agreeing to be bound by the above terms and conditions.

The customer also agrees that a violation of any of ASA’s terms and conditions by themselves or one of their group members may result in cancellation of any activity booked with ASA with no refund.
